1. Acceptance of Terms

By accessing or using the CoreSpade software, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the service.


2. License Use

CoreSpade grants you a personal, non-transferable license to use the software. You may not modify, distribute, or reverse-engineer the software.


3. Fair Play and Platform Compliance

CoreSpade is designed as a productivity and window-management tool. Before release I disclose to each supported poker room what CoreSpade does and ask for a review; the current status of every room is published on the compliance page. If a room informs me that CoreSpade is not permitted, I remove support for that room without undue delay. I do not monitor every operator’s terms continuously, poker site policies change frequently, and the ultimate responsibility for ensuring that your use of the software complies with the specific rules of the poker sites you play on rests entirely with you, the user.

Account Bans and Fund Seizures: Using any third-party software involves inherent risks. Under no circumstances shall CoreSpade or its developer be held liable or responsible for any account suspensions, bans, warnings, or the seizure of funds by any poker platform, even if the platform specifically cites CoreSpade as the reason for their action. You choose to use this software strictly at your own risk.


4. Subscriptions, Right of Withdrawal and Refunds

Subscription fees are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.

Right of withdrawal for consumers: If you are a consumer resident in the European Union, you have a statutory right to withdraw from the contract within fourteen days, without giving reasons. For digital content supplied immediately, this right expires only if you have expressly consented to immediate performance and have acknowledged that you thereby lose your right of withdrawal. That consent is obtained during checkout; without it, the fourteen-day period applies in full.

Beyond the statutory right of withdrawal, subscription fees are generally non-refundable, as the software is supplied as digital content. Statutory warranty rights remain unaffected.


5. Warranties and Limitation of Liability

CoreSpade is provided as it is at the time of delivery. I do not warrant that the software will be free of errors or that it will run without interruption. Statutory warranty rights for defects remain unaffected by this.

Liability: I am liable without limitation for damages caused intentionally or through gross negligence, for injury to life, body or health, and where liability is mandatory under the German Product Liability Act.

In cases of slight negligence, I am liable only where a material contractual obligation is breached, meaning an obligation whose fulfilment makes proper performance of the contract possible in the first place, and on whose observance you may regularly rely. In such cases liability is limited to the damage typically foreseeable for this type of contract. Any further liability for slight negligence is excluded.

What that means in practice: CoreSpade moves windows and sends keystrokes. It does not decide how you play, and it cannot know whether a click was the one you wanted. Losses at the tables, whether from a misclick, a hotkey that fired late or an overlay drawn in the wrong place, are not something I can carry for you. That is why the limitation above exists, and why nothing in it touches the cases where the law says I must answer.


6. Price Guarantee

CoreSpade is free during the alpha and the beta. When the beta phase ends, the prices published at that time apply, and those prices will not be increased for three years from the end of the beta. This period is the same for every customer; it is not counted from the start of an individual subscription, and it is neither shortened nor extended by cancelling and subscribing again. Not covered are changes in statutory taxes or duties, fees charged by the payment provider or merchant of record, and currency conversion, since prices are stated in US dollars. None of these are set by me. After the three years, any change will be announced at least one month in advance, and you may cancel before it takes effect. The end of the beta phase will be announced on this website.


7. Governing Law and Place of Jurisdiction

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.

Place of jurisdiction: If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is my registered place of business. If you are a consumer, the statutory places of jurisdiction apply. In particular, you may bring proceedings before the courts of the country in which you are resident.

Online dispute resolution: The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. I am neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.


8. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.


9. Indemnification

If you use CoreSpade in breach of these Terms, or in breach of the rules of a poker platform, and a third party raises claims against me as a result, you will indemnify me against those claims to the extent that the breach is your responsibility. This does not apply where you are not at fault. I will inform you without delay of any such claim and will not settle it without your consent.


10. Term and Termination

Either party may terminate the subscription with effect from the end of the current billing period. The right to terminate for good cause without notice remains unaffected for both sides; good cause on my part exists in particular if you breach these Terms materially or repeatedly, or if you use the software in a way that puts other users at risk.

If I terminate without good cause, fees already paid for the remaining term are refunded on a pro rata basis. Upon termination your right to use the software ends.


11. Changes to the Software and to these Terms

Software: CoreSpade is developed continuously. I may add, change or remove features, in particular where a poker platform changes its client or its rules. Where a change materially reduces the agreed scope of the software, you may terminate the subscription at the point the change takes effect and receive a pro rata refund.

Terms: I may amend these Terms with effect for the future. You will be notified by email at least six weeks before the change takes effect. The amendment is deemed accepted unless you object before that date; the notification will point this out to you separately. If you object, the contract continues on the previous terms, and either party may terminate at the end of the current billing period.
